Driving laws in Victoria differ depending on whether your medicine contains THC. You must never drive while impaired, and Victorian law prohibits driving with detectable THC in your system.

Victoria changed the law so that from 1 March 2025, if a driver tests positive for THC but was using prescribed medicinal cannabis as directed and was not impaired, the magistrate no longer has to automatically cancel or disqualify their licence. Instead, the court can look at the prescription, the circumstances and any evidence of impairment, and then decide whether a loss of licence is fair. It’s still an offence to drive with THC in your system — the change only adds judicial discretion to the penalty.
